StayInPlay ("StayInPlay," "we," "us," or "our") is operated by Game Improvement Apps, LLC, a Florida limited liability company. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use the StayInPlay mobile application, website, or related services (collectively, the "Services").
StayInPlay provides stretching, warm-up, mobility, exercise, and fitness-related routines intended for general informational and recreational purposes.
Your use of StayInPlay is also governed by our Terms of Service, which contain important provisions concerning assumption of risk, disclaimers of warranty, limitations of liability, and a binding arbitration agreement and class action waiver.

If you purchase a StayInPlay subscription or other paid service, the transaction is processed by Apple, Google, or another applicable app marketplace or payment provider.

We do not receive or store your complete payment card number when purchases are processed through an app marketplace.
StayInPlay records information about your use of routines, such as which routines you view, start, complete, or repeat, your streaks and progress, and preferences you set within the app.
StayInPlay does not collect medical records, diagnoses, medical history, laboratory results, prescription information, or clinical health data. We do not use activity information to diagnose, treat, or assess any medical condition.
Certain state privacy laws define "consumer health data" broadly enough that activity, exercise, and bodily-function information may fall within their scope regardless of how we characterize it. Please see our separately posted Consumer Health Data Privacy Policy for the disclosures and rights those laws provide.
StayInPlay does not currently read from or write to Apple Health / HealthKit. If we introduce HealthKit integration, we will request your separate permission, and we will not use HealthKit data for advertising, marketing, or data-broker purposes, or disclose it to third parties for those purposes.

Where we rely on consent, you may withdraw it at any time; withdrawal does not affect processing carried out before withdrawal. Where we rely on legitimate interests, you may object as described in Section 9.
We use third-party companies and technologies to operate, analyze, monetize, and improve StayInPlay. These providers may process information about you or your device.
StayInPlay uses services provided through Google Firebase, which may include Firebase Authentication, Firebase Analytics, Firebase Crashlytics, Firebase Cloud Messaging, cloud infrastructure, and related functionality. Depending on the services enabled, Firebase may process device identifiers, app interactions, usage information, diagnostic information, crash reports, IP addresses, and other technical information.
We use Google Analytics technologies to understand user behavior, evaluate feature performance, and improve StayInPlay. Google may process usage, device, and identifier information in connection with these services. StayInPlay includes the Meta SDK. We use Meta advertising and measurement products to promote StayInPlay, measure the performance of our advertising, attribute app installs and in-app events to campaigns, and build audiences for advertising.
Where permitted, the Meta SDK may transmit information such as device identifiers, IP address, app events (for example, app install, registration, trial start, subscription purchase), and technical information to Meta. Meta may use this information in accordance with its own terms and policies, available at https://www.facebook.com/privacy/policy.
This activity may constitute a "sale" or "sharing" of personal information under certain state privacy laws. See Section 5.
StayInPlay uses RevenueCat to manage in-app subscriptions, purchases, entitlements, and related analytics. RevenueCat may receive transaction identifiers, subscription status, app-user identifiers, product information, and related technical information.
If you download StayInPlay through the Apple App Store or make an in-app purchase on an Apple device, Apple processes information relating to your download, device, account, or transaction under Apple's own terms and privacy policy, available at https://www.apple.com/legal/privacy/.
If you download StayInPlay through Google Play or make an in-app purchase on an Android device, Google processes information relating to your download, device, Google account, and transaction under Google's own terms and privacy policy, available at https://policies.google.com/privacy. Google Play may also process install referrer and campaign attribution information, which we may receive through the Google Play Install Referrer API to measure advertising performance.
We receive subscription and entitlement information from these marketplaces as described in Section 1, and we do not receive your complete payment card details from either.
We do not currently use a third-party mobile measurement or attribution partner (such as AppsFlyer, Adjust, Branch, or Singular). We may engage one in the future to measure advertising performance and attribute installs and conversions. If we do, such a provider may receive device identifiers, IP address, install and event data, campaign and referral information, and related technical information. We will update this Privacy Policy and, where required by applicable law, obtain your consent before doing so.
We may add, change, or remove service providers as StayInPlay develops, including providers of cloud hosting, email delivery, customer support, push notification delivery, and security services. We will update this Privacy Policy when our data practices materially change.
On Apple devices, StayInPlay will present Apple's App Tracking Transparency ("ATT") prompt before accessing the Identifier for Advertisers (IDFA) or tracking you across apps and websites owned by other companies.
You can change your choice at any time in Settings → Privacy & Security → Tracking on your device.
On Android devices, we and our advertising partners may use the Google Advertising ID (AAID) and related information for advertising, personalization, and measurement, subject to your device settings and, where applicable, your consent.
You can control this at any time in Settings → Privacy → Ads (or Settings → Google → Ads, depending on your device), where you may delete your advertising ID or opt out of ad personalization. If you delete your advertising ID, apps will receive a string of zeros in place of it, and we and our partners will not use it for personalized advertising.
Depending on your device and Android version, advertising measurement may also be delivered through Google Play Services privacy-preserving APIs, including the Privacy Sandbox on Android where available.
If you are located in the EEA, the UK, or Switzerland, we will request your consent before setting non-essential analytics or advertising identifiers or transmitting data to advertising partners, and we honor consent signals through Google Consent Mode and equivalent mechanisms. You may change your choices at any time in the app's privacy settings.
Where required by applicable law, we honor opt-out preference signals, including the Global Privacy Control (GPC), transmitted through your browser on our website.
Our website may use cookies and similar technologies for functionality, analytics, and advertising. You may control cookies through your browser settings and, where applicable, through the consent banner presented on our website.
Certain state privacy laws, including the California Consumer Privacy Act as amended ("CCPA"), define a "sale" as the disclosure of personal information for monetary or other valuable consideration, and define "sharing" as the disclosure of personal information for cross-context behavioral advertising.
We do not sell personal information for money. However, because we use advertising and measurement technologies including the Meta SDK, our disclosure of identifiers, device information, and app activity to advertising partners may constitute a "sale" and/or "sharing" under those laws.
The categories of personal information that may be sold or shared are: identifiers (including device and advertising identifiers and IP address), internet or other electronic network activity information (including app usage and event data), commercial information (including subscription and purchase events), and inferences drawn from that information. These may be sold or shared with advertising networks, analytics providers, and marketing partners for the purpose of advertising, audience building, and campaign measurement.
We do not knowingly sell or share the personal information of consumers under 16 years of age.

We provide information to vendors that perform services for us, including cloud hosting, authentication, analytics, crash reporting, subscription management, advertising and measurement, customer support, email delivery, security, and infrastructure. These providers are contractually limited to processing information for the purposes we specify and as permitted by applicable law.

We may disclose information if we reasonably believe disclosure is necessary to comply with a law, regulation, legal process, subpoena, or governmental request; to enforce our agreements or policies; to investigate fraud, security issues, or illegal activity; or to protect the rights, property, or safety of StayInPlay, Game Improvement Apps, LLC, our users, or others.
If Game Improvement Apps, LLC or StayInPlay is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar transaction, information may be disclosed or transferred as part of that transaction.
We may disclose information when you request or authorize us to do so.
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy.
We may retain information longer where necessary to comply with legal obligations, resolve disputes, prevent fraud or abuse, or establish, exercise, or defend legal claims. We may retain aggregated or de-identified information indefinitely.
We use reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure, including encryption in transit, access controls, and vendor diligence.
No method of electronic storage or transmission over the internet can be guaranteed to be completely secure, and we cannot guarantee the absolute security of information. You are responsible for maintaining the confidentiality of your account credentials.
Depending on where you live, you may have the right to:
Email support@gameimprovementapps.com with the subject line "Privacy Request," or use the in-app controls under Settings → Privacy. You may delete your account and associated data directly in the app under Settings → Account → Delete Account.
We will take reasonable steps to verify your identity before fulfilling a request, which may include confirming control of the email address associated with your account or asking you to confirm information already in our records. We will not use verification information for any other purpose.
An authorized agent may submit a request on your behalf with written permission signed by you, and we may require you to verify your identity directly with us.
We will confirm receipt of a request within 10 business days and respond within 45 days, subject to an extension of an additional 45 days where reasonably necessary, in which case we will notify you. Where the EU or UK GDPR applies, we will respond within one month, extendable by two further months for complex requests.
If we decline your request, you may appeal by replying to our decision or emailing support@gameimprovementapps.com with the subject line "Privacy Appeal." We will respond in writing within 45 days (or as otherwise required by applicable law) and, if the appeal is denied, will provide information about how to contact your state attorney general.
If you are in the EEA, the UK, or Switzerland, you have the right to lodge a complaint with your local data protection supervisory authority. If you are in California, you may contact the California Privacy Protection Agency.
Nevada residents may submit a verified request directing us not to sell certain covered information by emailing support@gameimprovementapps.com.
StayInPlay is not directed to children under 13, and we do not knowingly collect personal information from children under 13. Our Terms of Service require users to be at least 13 years of age (or the minimum age of digital consent in your jurisdiction, if higher).
If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will take reasonable steps to delete it promptly. We do not knowingly sell or share the personal information of consumers under 16, or use it for targeted advertising.
Parents or guardians who believe a child has provided personal information to us may contact support@gameimprovementapps.com.
Game Improvement Apps, LLC is located in the United States, and information we collect is processed and stored in the United States and in other countries where our service providers operate. Data protection laws in those jurisdictions may differ from those where you reside.
EEA, UK, and Switzerland. Where we transfer personal information out of the EEA, the UK, or Switzerland, we rely on the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum, where applicable), or another lawful transfer mechanism. You may request a copy of the relevant safeguards by contacting us.
Canada. We handle personal information in accordance with PIPEDA and, where applicable, Quebec's Law 25. Our privacy officer may be reached at support@gameimprovementapps.com.
Australia. We handle personal information in accordance with the Australian Privacy Principles. You may complain to us at the address above, and to the Office of the Australian Information Commissioner if unsatisfied with our response.
StayInPlay may contain links to, integrate with, or rely upon services operated by third parties. We are not responsible for the privacy, security, content, or practices of third-party services. Your interactions with those services are governed by their own privacy policies and terms.
We may update this Privacy Policy periodically. When we do, we will update the "Effective Date" and "Last Updated" fields above. If changes are material, we will provide additional notice through the app, by email, or as otherwise required by applicable law, and where required we will obtain your consent.
